Terms of Service

By accessing or using Graphkit (graphkit.io), you agree to be bound by these Terms of Service. If you do not agree, please do not use the platform.

1. Service Description

Graphkit provides AI-powered image processing tools: vectorization, background removal, image upscaling, and a picture editor. Free users receive a watermarked preview from the vectorizer. Full outputs require a one-time payment or a Premium subscription.

2. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at hello@graphkit.io if you suspect unauthorized access.

3. Payment Terms

• Pay-per-vector: $3 per vectorized file download (choice of SVG, EPS, PDF, or Adobe Illustrator AI format)
• Premium subscription: $9.99/month — includes 10 vectorizations, 10 background removals, and 10 upscales per calendar month, plus unlimited picture editor use. Billed monthly, cancel anytime.
• Premium usage limits reset on the 1st of each calendar month and do not roll over.
• Refunds are available within 48 hours of purchase if the output is demonstrably unusable due to a platform error. Contact hello@graphkit.io.
• Payments are processed by Paddle (our Merchant of Record) and are subject to Paddle's Terms of Service. Paddle handles all applicable taxes including EU VAT.

4. Acceptable Use

You agree not to upload or process images that:

• Infringe any third-party intellectual property rights
• Contain illegal content, including child sexual abuse material
• Depict non-consensual intimate imagery
• Are intended to harass, defame, or harm any individual

You are solely responsible for having the rights to any images you upload. We reserve the right to suspend accounts that violate these terms without refund.

5. Intellectual Property

You retain full ownership of images you upload and outputs you download. By uploading, you grant Graphkit a limited, non-exclusive license to process your images solely to provide the requested service. Graphkit retains all rights to the platform, software, and AI models.

6. Service Availability

We aim for high availability but do not guarantee uninterrupted service. AI processing times depend on third-party APIs and may vary. We are not liable for delays or failures caused by upstream providers.

7. Disclaimer of Warranties

Graphkit is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement.

8. Limitation of Liability

To the maximum extent permitted by law, Graphkit's total liability to you shall not exceed the amounts you paid in the three months preceding any claim. We are not liable for indirect, incidental, special, or consequential damages.

9. Termination

You may delete your account at any time from your account settings. We may suspend or terminate accounts that violate these terms. On termination, your right to use the platform ceases immediately.

10. Changes to Terms

We may update these Terms at any time. Continued use of the platform after changes constitutes acceptance. We will notify registered users of material changes by email.

11. Governing Law

These Terms are governed by applicable law. Disputes shall first be attempted to be resolved by good-faith negotiation, then through binding arbitration if unresolved.
